1. Services
Haul & Hustle ("we," "us," "our") provides the client ("you," "your") with the services included in your plan:
- Starter: a custom website, access to our CRM / business software, automated review follow-up, Google Business Profile optimization, and Facebook Ads setup and management.
- Pro: everything in Starter, plus Google Local Services Ads and Google Search Ads setup and management.
- CRM Only: access to our CRM / business software (including automated review follow-up), setup with your business details, and ongoing support and updates. It does not include a website, Google Business Profile work, or ad management, and the website-related sections of these terms (2, 3, and 6) don't apply to it.
- CRM + Website: everything in CRM Only, plus a custom website. It does not include Google Business Profile work or ad management. All sections of these terms apply to it.
Unless otherwise agreed in writing, we host your website on our infrastructure for the term of your service agreement.
2. Domain Ownership
You are responsible for registering and owning your domain name through your own registrar account (e.g., Namecheap, GoDaddy, Google Domains). We do not register, hold, or control domain names on your behalf. If we assist with registration, the registrant contact will be set to you, not us.
3. Hosting
- Hosting is included in your monthly plan fee.
- Hosting includes uptime monitoring, minor updates, and basic technical support.
- Hosting does not transfer ownership of the underlying code or design to any third-party host. If your service ends, a new site build or a buyout (Section 6) would be required to move elsewhere.
4. Payment
- The one-time setup fee ($1,500 for Starter, $2,500 for Pro) is due with your first invoice.
- The monthly plan fee ($697/mo for Starter, $1,497/mo for Pro, $197/mo for CRM Only or CRM + Website) is due on the 1st of each month. CRM Only has no setup fee; CRM + Website has a $799 one-time website build fee, due with your first invoice.
- Moving from CRM Only to Starter or Pro carries that plan's full one-time setup fee; moving from CRM + Website carries the difference between the $799 build fee and that plan's setup fee. The new plan's monthly fee applies from then on.
- Upgrading from Starter to Pro carries a one-time $1,000 setup fee (the difference between the two setup fees), and the Pro monthly fee applies from then on.
- If payment is more than 15 days past due, your website will be taken offline (or, on CRM Only, CRM access paused) until the account is brought current. Your data is kept while access is paused.
- Non-payment beyond 30 days may result in termination of service and removal of the site.
4a. Ad Spend
Advertising spend is paid directly by you to Google and/or Meta through your own ad accounts and is not included in your setup or monthly fees. We manage your campaigns but never hold or pay your ad budget on your behalf.
5. Termination & Offboarding
- Either party may terminate this agreement with 30 days' written notice.
- Upon termination, your website is taken offline and your license to use it ends (Section 6). We are not obligated to provide the underlying site files unless the buyout option is purchased.
- We are not obligated to migrate or re-host your site with another provider.
- Your domain remains yours and is unaffected by termination, since it is registered in your own name (Section 2).
6. Content & Ownership
Haul & Hustle retains ownership of the website design, code, and underlying files created for you. Your monthly payment grants you a license to use the site for as long as you remain an active client in good standing — it is not a sale or transfer of the code or design.
If your account is terminated, cancelled, or falls into non-payment beyond the grace period above, your license to use the site ends and we are not obligated to provide the site files to you.
Buyout option: if you'd like a full copy of your site files and a release from this license — for example, to self-host or move to another provider — we offer this as a one-time buyout for $999.
Text, photos, and business information you provide to us (your logo, business name, photos, testimonials, and similar materials) remain your property regardless of this section.
We retain the right to feature completed work in our own portfolio and marketing materials, unless you request otherwise in writing.
7. Lead Data & Your CRM Data
- Leads submitted through the booking/quote form on your website, and leads from ad campaigns we manage, flow into the CRM included in your plan. You and your employees receive logins to the CRM for as long as you remain an active client in good standing.
- Leads generated through Facebook or Google ad campaigns we manage on your behalf are viewable directly in your own Facebook Ads Manager / Google Ads account, to which you'll be given access.
- Your data is yours. Your customer list, job history, employee hours, and financial records in the CRM belong to you. When your account is terminated, we will provide an export of that data as spreadsheet (CSV) files before your access ends.
- CRM access, automated review follow-up, and lead forwarding end when your account is terminated.
8. No Uptime Guarantee & Liability
We strive for high uptime but do not guarantee 100% availability. We are not liable for lost business, leads, or revenue due to downtime, third-party outages, or issues outside our reasonable control. Our total liability under this agreement is limited to the fees you paid us in the preceding three months.
9. Changes & Revisions
One minor content update (a text or image swap) is included per month. Anything larger, such as new pages, redesigns, or new features, is billed at $150 per hour, and we'll give you an estimate before starting.
10. Governing Law
This agreement is governed by the laws of the State of Washington.
